There are a few similarities when it comes to a solo 401k plan and a regular 401k plan that is used in many large businesses. A self-employed 401k plan is also very different from a regular 401k plan. It is important that you understand these differences before you decide to offer this type of retirement plan to those who work for your small business.

Just like with a regular 401k plan, you cannot withdraw from your plan before the age of 59.5 unless you want to pay the 10% penalty as well as any taxes on the amount that you withdraw. There are some hardship requirements that you may qualify for but for most cases the penalty and taxes remain in effect. The amount that you are able to deposit on an annual basis is also the same for both types of 401k plans, which was $16,500 in 2009.

However, notes Carlos Hank Rhon, unlike most traditional 401k retirement plans, with a solo 401k plan you have the ability to set aside up to 25% of your income as long as the total investment doesn t exceed $49,000. This amount goes up to $54,500 once you reach the age of 50.

Novartis challenges patent rejection in India

The Swiss pharmaceutical company Novartis is about to challenge patent rejection in India before the Supreme Court of India. The court case is to begin on March 28.

Should the complaint be successful millions of people may no longer be able to purchase necessary medication.

The object of special attention is Imatinib, a medication used to treat certain cancers, which is marketed by Novartis as Gleevec (USA) or Glivec (Europe/Australia/Latin America).

The desired interpretation of patent law would give Novartis a renewal of another twenty years for its patent on the medication.

Over six years Novartis has been struggling over different interpretations of article 3(d) of Indian patent law, which rules the patenting of variants of already approved medicines. On March 28 Novartis will present another interpretation of article 3(d) restricting it to “discoveries”, while the patent application would constitute an “invention”.

[The case is] about the rewarding of innovation where markets exist, not about impeding access to medicines for poor patients.

Novartis’ head of corporate research in Basel, Paul Herrling, told the journal Nature: “[The case is] about the rewarding of innovation where markets exist, not about impeding access to medicines for poor patients. […] We think that Gleevec is a fundamental breakthrough in medicine. If 3(d) can be used to prevent the patenting of results of innovative biomedical research, it will certainly be a disincentive for both Indian research-based pharmaceutical companies and for foreign companies wanting to be active in India. This would be to the disadvantage of Indian patients.”

Brook Baker from the Northeastern University School of Law in Boston, Massachusetts, a professor in the Program on Human Rights and the Global Economy (PHRGE), explained the situation as follows: “Novartis would like the Supreme Court to adopt a low-threshold standard whereby slight improvements will count as significantly enhanced efficacy. […] If this low-hurdle standard is adopted, companies will be able to evergreen their patents in India much as they do in the United States. […] India is a major exporter of generic medicines to developing countries, including 80% of the medicine now used to treat over 6.6 million people living with HIV/AIDS. India’s status as the pharmacy of the poor and of the developing world is actually under attack.”

High winds in Texas cause property damage and utilities loss for many

Wind storms swept across a large part of Texas on Wednesday, leaving property damaged and many homes without power.

Downed lamposts and trees were reported in multiple locales. One media source reported overturned playground equipment in the city of Rockwall. Winds up to 40 miles-per-hour (mph) were reported over much of the Dallas-Fort Worth Metroplex. Approximately 9,500 people within Tarrant and Dallas counties were without electrical power as late as Thursday afternoon.

Late Wednesday evening, the National Weather Service reported winds at Dallas Love Field up to 66 mph. The city of Edgewood recorded wind speeds up to 70 mph during the storm; three homes, two barns and two business buildings sustained damage. A home in Chandler was damaged when a tree was toppled during the storm (see photo at left).

Dust from as far away as west Texas covered vehicles and other property early Thursday morning in the eastern part of the state. A car wash manager in Tyler told media his business cleaned about three hundred cars on Thursday, busier than usual even for holiday season.

Obama to suspend Arctic oil drilling

According to Democratic Senator Mark Begich from Alaska, the U.S. Department of the Interior has decided to halt all new Arctic exploratory oil drilling applications until 2011. The response is believed to be caused in part by the two current oil spill disasters (that of the Deepwater Horizon Incident and more recently the Alaska oil pipeline malfunction). However, Begich is not happy about the actions taken by the White House.

“I am frustrated that this decision by the Obama administration to halt offshore development for a year will cause more delays and higher costs for domestic oil and gas production to meet the nation’s energy needs,” Begich claims.

Last September, the state of Alaska made a public notice about Shell’s desire to drill off the coast of the Beaufort Sea, placing experimental drilling rigs at two drill site location: “Torpedo” and “Sivulliq”.

“Shell is committed to undertaking a safe and environmentally responsible exploration program in the Chukchi Sea and Beaufort Sea in 2010,” said Shell Oil Company President Marvin E. Odum to the U.S. Department of the Interior’s Mineral Management Service (MMS).

Odum follows with, “I am confident that we are ready to conduct the 2010 Arctic exploratory program safely and, I want to be clear, the accountability for this program rests with Shell.”

Chuck Clausen, director of the Alaska project at the Natural Resources Defense Council is not so optimistic: “Hazards present in the Arctic can include frigid temperatures, presence of sea ice, gale-force winds, intense storms and heavy fog … The potential for loss in the Arctic is great.”

Odum believes that the climate in the arctic will make any spill easier to clean up because, “Arctic conditions create differences in responding to oil in cold and ice conditions. Differences in evaporation rates, viscosity and weathering provide greater opportunities to recover oil. In Arctic conditions, ice can aid oil spill response by slowing oil weathering, dampening waves, preventing oil from spreading over large distances, and allowing more time to respond.”

However, Clausen believes that there are no current systems to remove oil from icy ocean waters.

This is not the first time that President Obama’s administration has taken the environmentally cautious path in Alaska. The President put Bristol Bay off limits to oil and gas exploration until 2017. Bristol Bay currently is one of the top salmon fishing grounds in the state.

Interior Secretary Ken Salazar is expected to give a speech at Thursday’s White House address, regarding the suspension of Arctic oil drilling projects.

There was a time when people hated being caught on camera and then seeing the video find its way to YouTube. But Chris Christie seeks out cameras and loves to be seen on the site. Town hall meetings last year were prime fodder for YouTube videos, and most of the politicians hated being followed into these meetings by the press or other photographers. But Chris Christie s plans included being on tape .

He was in South Jersey to gather support for what he called his tool kit , which is a set of proposals to help his state comply with a property tax cap. He spoke under a banner that proclaimed Christie Reform Agenda . He was waiting for the Democratic-controlled legislature in his state to pass reforms, and with less than two months left to get it done, they had gone on vacation for two weeks.

Christie was having the meeting of a town hall type for more purposes than just to promote his reformation agenda. He also wanted to gather Internet video content. While other governors spent time using YouTube to show simple speeches and the like, Christie welcomed debate and has turned his video library into such a popular place that his followers even rank favorites they have among the list.

Christie had one town hall meeting where he spoke with a public school teacher who had complaints about her salary. He told her that she knew what the pay scale was when she went in, and she could choose another occupation if the salary wasn’t enough for her. Another town hall meeting found him speaking with a reporter who said his tone was confrontational. He told the reporter that he must surely be the man with the thinnest skin in the country, because the governor wasn’t even mad.

Whenever Christie travels, he has an aide who films moments like these. When they occur, as they inevitably will, his press assistants splice the video and put it on YouTube, and conservatives can share the clips. They think it’s a golden chance to see the way Christie handles himself in town hall meetings, and they are often forwarded. One video where Christie spoke to another school teacher has had more than 750,000 views at YouTube.

Christie does insist that since he listens patiently to all the questions directed to him, that the questioners listen to his reply. He’s a heavy man to start with, and he’s almost larger than life, on-stage and in YouTube videos.

You never know what will be a hit and what will be ignored on YouTube, but it’s certainly fun to discover the newest videos and the way people unite around them, showing the power of You Tube.

U.S. military confirms Qur’ans were kicked, stepped on and splashed with urine at Guantanamo

On Friday, the U.S. military released the results of their investigation and confirmed that in 5 separate incidents, American guards at the Guantánamo Bay prison “mishandled” the Islamic holy book. However, they stress that guards were usually “respectful” of the Qur’an.

One incident involved splashing a Qur’an with urine by urinating near an air vent while others involved kicking, stepping on and writing in Qur’ans.

Brigadier-General Jay Hood, the commander of the jail, said that these incidents are the exception to the rule. In a statement issued late Friday, he said: “The inquiry … revealed a consistent, documented policy of respectful handling of the Qur’an dating back almost two-and-a-half years.”

Gen. Hood looked into the allegations, published and then retracted by Newsweek, that American personnel flushed a Qur’an down a toilet. He said that the inquiry did not find any evidence supporting this particular allegation. “The inquiry found no credible evidence that a member of the Joint Task Force at Guantanamo Bay ever flushed a Qur’an down a toilet. This matter is considered closed.”

The incidents reported are:

  • a guard kicking a prisoner’s Qur’an;
  • Qur’ans wetted by water balloons thrown by guards;
  • a “two-word obscenity” written, in English, inside the cover of a Qur’an. Military officials state that it is equally possible that a guard wrote this in the prisoner’s Qur’an or that the prisoner wrote this in his own Qur’an;
  • a guard who urinated too close to an air vent, spraying a Qur’an with urine;
  • an interrogator who stepped on a Qur’an during an interrogation.

The investigation also revealed 15 alleged cases of Qur’an mistreatment by detainees themselves. Detainees used Qur’ans as pillows, urinated on them, and, several times, tore pages out of copies of the books, according to the report. For example, the report states that a guard observed a “detainee place two Qur’ans in his toilet and state he no longer cared about the Qur’an or his religion,” on February 23, 2004. It is believed that such behavior is intended to cause disruption and problems for the guards.

A 30 meter section of a gas pipeline in Luka (near Kiev) in Ukraine has been destroyed by an explosion. Although supplies to Europe via this pipeline have stopped, Ukrainian Energy Minister Georgi E. Boyko said that supplies to Europe would not be affected.

“There are no changes in volumes of gas being transported,” Yuri Korolchuk said. “Volumes due to pass through the damaged section are being redirected through the Soyuz pipeline.”

Normal flows are reported in the Czech Republic, Hungary, Poland and Romania.

Copper prices are rising. Between record copper imports from China, and a mining strike in Peru, the prices have climbed to over $8100 (United States dollars) a tonne, for a gain of $575 dollars over the last week. However the upward trend is not new, it has been climbing for quite some time. In April 2003, the price of copper was under $2000 a tonne.

The metal market has been tending up due to growth in the Chinese industrial production. This trickles down to the local level, where the buying price at scrap yards is ever climbing, making scrap metal collection a more profitable endeavour for individual people using pick up trucks or other such vehicles to collect and cash in the scrap metal at metal buying yards. It can be collected via agreements with businesses, from the garbage, or, sometimes, by theft.

Copper prices fell today on the NYMEX commodity exchange from US$3.7545 per pound to US$3.7125 based on the July futures contract.

One man was killed and another injured by an exploding backpack in the parking lot of the Luxor Hotel in Las Vegas, Nevada. The explosion happened at 4 a.m. PDT when the victim tried to remove a the object left on top of his car.

Agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) are on the scene. Aerial images did not show any apparent damage.

“We believe the victim was the intended target of this,” Bill Cassell said, spokesperson for the Las Vegas Metropolitan Police Department. “This is being treated as a homicide in which the weapon used to cause death is a non-traditional weapon.”

Both of the victims worked at the Luxor.
